 Please read these Terms & Conditions (“Terms”, “Agreement”) carefully. By placing an order through our website or otherwise purchasing from us, you agree to be bound by these Terms.

1. Definitions

  • “We”, “Us”, “Our” refers to Elevation Cycles, trading as the bike-shop webstore.

  • “You”, “Your”, “Customer” refers to the person placing the order.

  • “Goods” means any bicycle, component, accessory, apparel or service offered for sale by us.

  • “Order” means your purchase of Goods via our website or other sales channel.

  • “Website” means our webstore located at www.elevationcycles.com.au

2. Eligibility & Contract Formation

  • By placing an Order you warrant that you are legally capable of entering into binding contracts, are at least 18 years old (or have consent of a parent or legal guardian if under 18), and that all information you provide is accurate and complete.

  • Our acceptance of your Order creates a contract between you and us. We may refuse or cancel your Order at any time before dispatch for any lawful reason (e.g., stock unavailability, pricing error, suspected fraud).

  • The contract is formed only once we have accepted payment and we dispatch the Goods to you.

3. Prices, Payment & Taxes

  • All prices are in Australian Dollars (AUD) and include GST where applicable.

  • Payment is required at time of ordering (or as otherwise stated). We accept credit card, bank transfer, after pay & Zip Money.

  • We endeavour to keep pricing accurate, but if an error occurs we may cancel the Order and refund you.

  • For Buy-Now-Pay-Later or similar credit arrangements, those services are subject to separate terms with the credit provider.

  • You are responsible for paying any duties, taxes or charges imposed by your country or shipping destination if we ship internationally (if applicable).

4. Goods, Availability & Specification

  • Goods descriptions, images and specifications are provided to give an approximate representation—actual appearance or performance may vary.

  • We cannot guarantee continuous availability of all items. If an item is unavailable we will contact you and either provide a substitute, delay dispatch, or cancel the Order with full refund.

  • Some Goods (especially bikes, framesets, custom builds) may have special conditions or lead-times—these will be clearly indicated on the relevant product page.

5. Shipping & Delivery

  • We aim to dispatch your Order within the timeframe stated on the Website (for example: within 24 hours for standard items) subject to stock availability and payment confirmation.

  • Shipping costs, delivery methods, and any restrictions (such as no P.O. Boxes for bulky items) are outlined on our Shipping Policy. For example: bikes may incur a higher freight cost, and may require street address delivery rather than a PO Box.

  • Title and risk in the Goods pass to you when the Goods are delivered to your nominated delivery address (or you or your nominated agent take possession).

  • Delivery times are indicative only; we are not liable for delays once Goods are with the freight carrier.

  • If you provide an incorrect address or fail to accept delivery, resulting in additional costs or return of Goods, you are liable for those costs.

6. Returns, Exchanges & Refunds

  • Our Return Policy sets out how returns, exchanges and refunds are handled (by reference to our 14-day policy for change of mind and the ACL rights for faulty items).

  • If you are a consumer under the ACL, you may have rights for repair, replacement or refund for major failures, or compensation for other reasonably foreseeable loss caused by the failure. These rights are not excluded by these Terms.

7. Consumer Guarantees & Limitation of Liability

  • Nothing in these Terms limits your rights under the ACL that cannot be excluded.

  • To the fullest extent permitted by law, our liability to you is limited to (at our option): replacing the Goods, repairing the Goods, or refunding the purchase price of the Goods.

  • We exclude all other liability for loss or damage, whether direct, indirect, special or consequential, caused by the Goods, their use or any delay in delivery—except to the extent such exclusion would contravene the ACL or other applicable law.

  • You warrant that you will use the Goods correctly and for their intended purpose, and follow the manufacturer’s instructions or any instruction we provide.

8. Custom-built and Special Order Goods

  • For custom or special order Goods (e.g., bikes built to specification, made-to-order frames), you acknowledge that changes and cancellations may be subject to additional fees and may not be eligible for change-of-mind returns.

9. Intellectual Property

  • All content on the Website (images, text, logos, trademarks) is owned by us or our licensors. You may not reproduce, republish, distribute or commercially exploit any part of the Website without our prior written consent.

10. Privacy & Data

  • Our collection, use and disclosure of your personal information is governed by our Privacy Policy. By ordering with us you consent to that Privacy Policy and its terms.

11. Force Majeure

  • We are not liable for any delay or failure to perform our obligations caused by an event beyond our reasonable control (including, but not limited to, strikes, shipping disruptions, natural disasters, pandemic, courier failures).

12. Amendments

  • We reserve the right to amend these Terms at any time without notice. The version applicable to your Order is the version in effect at the time you placed your Order.

13. Governing Law & Jurisdiction

  • These Terms are governed by the laws of Western Australia. You irrevocably submit to the exclusive jurisdiction of the courts of that jurisdiction.

14. General

  • If any provision of these Terms is found to be invalid, void or unenforceable by a court of competent jurisdiction, that provision will be severed and the remaining provisions will continue in full force and effect.

  • Our failure or delay to enforce a right or provision in these Terms does not constitute a waiver of such right or provision.

  • These Terms (together with our Return Policy, Shipping Policy and Privacy Policy) constitute the entire agreement between you and us regarding your purchase of Goods from us.
